Actively Defending

Membership Terms and Acceptable Use

01What this agreement covers

These terms govern the I Am Actively Defending membership, operated by Active Intel Investigations LLC, a licensed Florida private investigation agency (“we”, “us”, “the Agency”). By completing checkout you agree to these terms and to the acceptable use rules in Section 9.

Membership is sold to individuals for their own use. It is not sold to organizations, and it may not be shared, resold, or transferred.

Membership
The monthly subscription described in Section 2, at the price shown at checkout.
Member materials
The course, notice materials, request letter templates, certificate, member number, and anything else delivered to you as part of membership.
Your record
The documentation you build and store in your own accounts. See Section 8.
Investigation engagement
Case work performed by the Agency under a separate signed agreement. See Section 10.

02What membership includes

For the monthly fee shown at checkout, membership includes:

  • A member number and a dated certificate, issued after your first payment clears.
  • A welcome kit mailed to the address you give at checkout.
  • Access to the member portal and the documentation course while your membership is active.
  • Printable notice materials carrying your member number.
  • One included deliverable in each month you remain a member, on the schedule published in the portal. Deliverables may be substituted for items of comparable value.
  • The ability to submit questions to the monthly live session (Section 7).
  • Two members-only training sessions each month, with replays in the member portal (Section 7).
  • A member rate on investigation engagements, beginning after sixty days of continuous membership (Section 10).

Membership is limited. We may cap the number of active memberships, pause new enrollment, or keep a waitlist at any time. A cap or pause does not affect an active membership.

Deliverables that require your signature, such as records request letters, are prepared for you to sign and send yourself. We do not sign, send, or file anything on your behalf, and we do not represent you before any agency or court.

03What membership is not

Not legal advice. Nothing in this membership is legal advice, and nothing creates an attorney-client relationship. We are investigators, not lawyers. Where your situation calls for legal advice, retain a lawyer.

Not a consumer report. Nothing provided under this membership is a consumer report or an investigative consumer report under the Fair Credit Reporting Act. No material provided may be used, in whole or in part, to make or influence any decision about credit, insurance, employment, housing or tenancy, government benefits, or any other purpose governed by the FCRA. Using it that way is a breach of these terms and may be unlawful.

Not an official status. Your member number and certificate are issued under a private registry operated by the Agency. They are not a government registration, license, credential, or law enforcement designation, and they confer no governmental, official, or enforcement authority of any kind. Presenting them as such is a breach of these terms.

Not an investigation. Membership does not include investigative work of any kind, and no one at the Agency is assigned to your situation because you joined. Investigation is a separate engagement (Section 10).

Membership also does not include monitoring, surveillance, or any service directed at another identified person.

04Your member number and certificate

Your member number is issued to you and stays with you for as long as your membership is active. It identifies a membership; it does not certify, verify, or vouch for any fact about you or about anyone else, and it does not attest that anything you have documented is accurate.

If your membership lapses or is cancelled, the number is marked inactive. We hold a lapsed number for ninety days, during which restarting returns the same number; after that it is retired and a new membership receives a new number.

We do not publish member names, addresses, or situations, and we do not confirm anything about a member to a third party beyond whether a number is currently active.

05Billing, renewal, and cancellation

Recurring charge

Membership bills monthly, in advance, to the payment method you provide, at the price shown at checkout, until you cancel. By joining you authorize that recurring charge. Payment is processed by our payment processor; we do not store your full card details.

Failed payments

If a payment fails we will attempt it again over several days and email you. If it has not cleared after those attempts, membership pauses: portal access is switched off and your number is marked inactive, held for ninety days as described in Section 4.

Cancellation

You can cancel at any time from the billing page in your portal, or by emailing us. There is no contract, no minimum term, and no cancellation fee. Cancellation takes effect at the end of the period you have already paid for; access continues until then.

Refunds

Monthly fees already charged are not refunded, because the month’s deliverable has generally already been produced or shipped. If something went wrong on our side — a kit that never arrived, a deliverable we failed to send — tell us and we will make it right, by replacement or by refund at our discretion.

Price changes

We may change the membership price. If we do, we will email you at least thirty days before it applies to your account, and you can cancel before it takes effect.

06Physical items and shipping

Physical items ship to the address you provide at checkout. Keep it current in your portal; we are not responsible for items sent to an address you did not update.

We ship within the United States. If an item arrives damaged or does not arrive, tell us within thirty days and we will send a replacement at no cost.

Physical items are yours to keep, including after cancellation. They carry a member number that will be inactive once your membership ends, and they should not be represented as current after that point.

07The monthly live session and member trainings

The session streams publicly to third-party platforms and remains available afterward. Anyone can watch it. Members are the only people who can submit questions to it.

You are not shown or identified in the session. There is no camera, microphone, or attendee list. Questions are submitted privately, and before any question is answered it is reworded and stripped of names, places, relationships, and other identifying detail. Questions are never read as submitted and never displayed.

It is still a public broadcast. Do not submit anything you would not want discussed in general terms in public. Do not submit another person’s name or identifying details. We are not able to un-say something once it has aired.

Answers given in the session are general information, not advice about your situation, and no confidential or privileged relationship is created by submitting a question or by anything said in reply. We may decline to answer any question, and we do not answer questions posted in the public comment sections of the streaming platforms.

Members also have access to two training sessions each month, led by Dave Pelligrinelli or another Active Intel investigator. Trainings are for members only and are not streamed publicly. Replays are posted in the member portal and remain available while your membership is active. Trainings are general instruction on documentation and records methods, not advice about your situation, and no confidential or privileged relationship is created by attending one or by anything said in it.

We may cancel, reschedule, or shorten a session or a training. If a session or training does not happen, that does not entitle you to a refund of that month.

08Your records stay yours

The documentation method in this membership has you build and keep your record in your own cloud account or on your own device. We do not host it, we do not have a copy of it, and we cannot retrieve it for you. That is deliberate, and it means your record does not depend on this membership continuing.

Do not upload your record to the member portal. The portal delivers material to you; it is not storage for your documentation.

If you email us something for review, you are giving us a copy of it, and you confirm that you have the right to share it. We keep what you send us only as long as we need it to respond, and we do not publish it or give it to anyone outside the Agency except where the law requires it.

We keep the account information you give us — name, contact details, shipping address, billing records, member number, and correspondence — for as long as your membership is active and afterward as our records and the law require.

09Acceptable use

Membership gives you a documentation method and materials that state, without naming anyone, that you are documenting. It is built that way on purpose. These rules keep it that way.

You agree that you will not

  • Add any person’s name, photograph, address, or identifying detail to notice materials, or alter them to make an accusation against anyone.
  • Use the membership, the member number, the certificate, or any member material to harass, threaten, intimidate, defame, or retaliate against any person.
  • Use anything provided to locate, track, monitor, surveil, or contact another person, or ask us to.
  • Represent your member number or certificate as a government registration, a license, a law enforcement credential, or an official finding.
  • Use any material for a purpose governed by the Fair Credit Reporting Act, as described in Section 3.
  • Examine, access, or ask us to examine a device or account you do not own or are not legally authorized to access.
  • Submit another person’s identifying details to the live session question form.
  • Share, resell, or republish member materials, or share your portal login.
  • Use the membership in any way that is unlawful, or that would require a professional license you do not hold.

What you are responsible for

You are responsible for what you document, what you send to anyone, and how you use every material we provide. We prepare request letters and notice materials; you decide whether to sign, post, or send them, and the consequences of doing so are yours.

You confirm that you are documenting a situation affecting you or your immediate family, and not acting on behalf of someone who is trying to build a case against a person they are in conflict with.

10Investigations are separate

Investigation work is never included in membership. It requires a paid consultation, a lawful basis for the work, and a separate signed engagement agreement, and it is quoted per case.

After sixty days of continuous membership, investigation engagements are quoted at the member rate. The member rate reduces the price of the same engagement; it does not change the scope, the standard of work, the intake, or our judgment about whether we will take a case. We decline work we cannot do lawfully or competently, member or not.

If your membership lapses, the member rate stops applying to work quoted after that point.

11Materials and license

The course, templates, notice materials, certificate design, and everything else we provide remain ours. While your membership is active you have a personal, non-exclusive, non-transferable license to use them for your own documentation.

You may keep and continue using copies you downloaded while you were a member. You may not resell them, republish them, distribute them, or use them to build a competing product or service.

12Disclaimers and limits

Membership and all member materials are provided as they are, without warranty of any kind. We do not promise any outcome. Documenting a situation carefully improves the quality of your record; it does not guarantee that anyone will act on it, that any agency will respond, that any record will be admitted anywhere, or that what is happening to you will stop.

We are not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost opportunity, arising out of the membership. To the maximum extent the law allows, our total liability for any claim arising out of the membership is limited to the amount you paid us in the twelve months before the claim.

You agree to indemnify the Agency against claims arising out of your own use of member materials, including any claim brought by a person who says they were harmed by something you documented, posted, sent, or published.

Nothing in this section limits liability that cannot be limited under applicable law.

13Suspension and termination

We may suspend or end a membership immediately, without refund, if a member breaches Section 9, if we believe the membership is being used to harm another person, or if continuing would put the Agency’s license or its obligations at risk.

We may also end a membership for any other reason on thirty days’ notice, refunding any unused period.

When a membership ends, the licenses in Section 11 end with it except for material already downloaded, and the member number is handled as described in Section 4.

14Changes to these terms

We may update these terms. If a change materially affects your rights, we will email you at least thirty days before it applies. Continuing your membership after that date means you accept the updated terms; if you would rather not, cancel before then.

15Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute arising out of the membership will be brought in the state or federal courts located in Palm Beach County, Florida, and you and we consent to that jurisdiction.

Before filing anything, email us and give us thirty days to resolve it. Most things get sorted out that way.
