Investigating Probate and Divorce Fraud
Investigating probate fraud or divorce fraud is one of the biggest areas we look at in our investigative services. We get more inquiries for these types of cases than really anything else.
Economic Pressures and Fraud
There is more pent-up demand for money these days. The economy is bad, inflation is bad, and the younger generations are feeling like they’re left behind. Right now, Gen X and Millennials feel like they’re left behind by Boomers, and they’re starting to try to get some of their inheritances earlier. So they’re putting people into conservatorships; they’re diverting money.
Struggling Heirs
If somebody does die, they’re trying to take money away from their other heirs, their other family members, because they’re struggling, right? They don’t have money, they can’t buy a house, their bills are backed up, they have student loans, and they have medical bills. So they’re struggling; they’re doing everything they can to survive, and by taking money away from other family members, that may just be what they have to do.
Importance of the Executor Role
The executor of an estate is a very important job, and sometimes the executor will do something either intentionally or unintentionally that will not have the money distributed properly. So if you’re at all involved with any kind of case where there’s a death in the family, somebody’s in conservatorship, or in a nursing home, make sure you’re documenting all of the evidence to ensure that the assets are being distributed as they’re supposed to be distributed. You get what’s coming to you; everybody else gets what’s coming to them, no more, no less.
Consequences of Misappropriation
Because if it doesn’t, now the person who took the money first of all, they’re disrespecting the wishes of the person who earned all the money. But you’re also improperly enabling them to believe that by doing something wrong, they can get away with it, and that’s not good either.
Ensure Proper Investigation
So make sure that you investigate properly, verify everything properly, and make sure the executor gives good reports. If you do need more information, you can click the link below.
